REPORTING COPYRIGHT INFRINGEMENT CLAIMS

Copyright infringement claims are taken seriously by us. Notices of alleged copyright infringement will be responded to if they comply with the Digital Millennium Copyright Act (“DMCA“) and any other applicable intellectual property laws or legislations. Responses may include removing, blocking or disabling access to material claimed to be the subject of infringing activity, terminating the user’s access to https://pussy.org (“Pussy.org“), or all of the foregoing.

You can file a copyright infringement notice if you feel that any content on Pussy.org is infringing your copyright. (See below, “Filing a DMCA Notification of Copyright Infringement”, for details on how to submit such a notice. Only the copyright owner, or an agent authorized by him to act for the owner, should submit these requests.

If we remove or disable access to material in response to such a notice, we will take reasonable steps to notify the user that uploaded the affected content material that we have removed or disabled access to so that the user has the opportunity to submit a counter notification (see below, “Counter-Notification Procedures” for instructions on filing a counter notification). We will document any notices of alleged infringement that we take.

All copyright infringement notifications and counter-notifications must be written in English. We reserve the right to disapprove of any attempts at notification in foreign languages or with foreign characters.

FILE A DMCA NOTICE of COPYRIGHT INFRINGEMENT

You are not requesting the removal of content. False claims are not allowed. You could lose your account or face other legal consequences if you misuse this process.

You may notify Pussy.org of alleged copyright infringement by sending an email to support@pussy.org.

We accept free-form copyright violation notifications. The DMCA requires that the notice must be in writing and include the following:

  • You must identify the copyrighted works you think have been infringed. If the claim is multiple works, you will need to provide a list of representative works.
  • Identification of the material that you believe is infringing your rights in a sufficient precise way to enable us to locate it. We may not be able to locate the video that you claim infringes on your rights if your complaint doesn’t contain the URL. It is not common to have general information about the video such as the channel URL or username. Please include the URL of the video(s).
  • We need to have sufficient information so that we and the uploader(s), of any videos you remove, can reach you. This includes your name, postal address and telephone number, as well as an e-mail address.
  • A declaration that you believe that the owner of the copyright, its agent, or the law has not authorized the use of the copied material.
  • An assertion that the written notice contains accurate information and, under penalty of perjury that you are the owner or agent authorized to act for the owner of the exclusive right being alleged to be infringed.
  • To complete a complaint, you must have either the electronic or physical signature of the copyright owner. You can sign your complaint by entering your full legal name.

Your DMCA Notice could be invalidated if you do not comply with the requirements of Section 512 (c)(3) of DMCA.

You may be held liable for damages if you knowingly misrepresent that Pussy.org material or activities infringe your copyright. This includes costs and attorney’s fees under Section 512(f).

Pussy.org will publish the name of the copyright owner in lieu of any disabled content. This information will be included in the public record of your DMCA notice, together with your description of the work(s), allegedly infringed. The DMCA Notice and the actual DMCA notice, including your personal information, may be sent to the person who uploaded the allegedly infringing material. You consent to your information being disclosed by submitting a DMCA notice.

COUNTER-NOTIFICATION PROCEDURES

If you received a DMCA notice and believe that Pussy.org material was removed or access disabled due to misidentification or error, you can file a counter-notification (a ” Contra-Notice“) with us. You must submit counter notifications by the original uploader of the video or an agent authorized for them to act on their behalf.

You must send counter-notices to the same email address, support@pussy.org.

The DMCA requires that the Counter-Notice contain substantially the following:

  • Your name, address and phone number.
  • The ability to identify the content allegedly infringing and its location prior to removal or access was disabled
  • Under penalty of perjury, a statement that you believe in good-fait that the content was deleted by mistake or misidentification.
  • A statement that you agree to the U.S. Federal District Court’s jurisdiction for the judicial area in which you reside (or, if you are not located in the U.S.A, for any judicial region in which the operator or Pussy.org might be found) and that you will accept service from the person who provided the DMCA notice or its agent.

We won’t respond to counter notifications if they don’t meet the above requirements.

We will review your Counter Notice once we have received it. This will inform the party that submitted the original DMCA Notice that the removed material can be restored within 10 business days, but not later than 14 days after we received your Counter Notice. Unless our Designated Agent receives notice from the person who filed the original DMCA Notice, in which case we will notify the designated agent that such party has initiated a court action to stop you from infringing the material.

We will send your Counter Notice to you. This will contain your personal information. You consent to the disclosure of your personal information by submitting a counter notice. The counter notification will not be sent to anyone other than the original claimant, law enforcement, or parties that help us enforce and protect our rights.

You may be held liable for damages, including costs and attorney’s fees, if you knowingly misrepresent that Pussy.org material or activity was removed or disabled due to mistake or misidentification.

REPEAT INFRINGERS

We have adopted a policy to disable or terminate accounts of repeat violators in accordance with the DMCA, and any other applicable laws. We have the right to limit access to Pussy.org and terminate or disable accounts of users who violate intellectual property rights. This applies regardless of whether there has been any repeat infringement.
